Welcome to beauVoyage! We provide the services for creating your personal travel blogs. The entity you are contracting with and that owns beauVoyage is the beauBateau GmbH, a company registered with the Chamber of Commerce in Germany under the number HRB 12758. The beauBateau GmbH is hereafter referred to as “beauVoyage”, “we”, “us” or “our”.
Please, read these Terms and Conditions carefully as they set forth our relationship to you as a user, as you interact with our services, and the rights and responsibilities that guide us both. By accessing or using the beauVoyage platform and services, you agree to comply with and be legally bound by these Terms.
You are solely responsible for ensuring that these Terms and Conditions are in compliance with all laws, rules, and regulations applicable to you. The right to access our service is revoked where these Terms and Conditions or the use of the service is prohibited. In such circumstances, you agree not to use or access the beauVoyage platform or its service in any way.
2. Scope of beauVoyage services
The beauVoyage platform acts as a host for your journey planning and travel experiences, maintaining the necessary infrastructure for publication and access. As the provider of this platform, beauVoyage does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any postings. All of the content that we host on the blogging websites is provided by members like yourself. We do not take over any responsibility for what you publish on the beauVoyage platform. Similarly, we do not endorse any member or opinions expressed via our services.That means you alone are legally responsible for the content of your blogs. So for your own protection, you should exercise caution and avoid creating any content that may result in criminal or civil liability under any applicable laws, including local laws, whose applicability depends on where you live or where you view or edit content. beauVoyage generally cannot offer any protection, guarantee, immunity or indemnification.
The beauVoyage online offerings may contain links to third party websites, apps, services or resources on the Internet. When you access third party websites, you do so at your own risk. Such embedded third party services may be subject to different terms and conditions and privacy practices. You acknowledge that beauVoyage is not responsible or liable neither for the content, data, functions, actions, products, or services such third party websites or resources offer nor for the availability, accuracy, legality, or appropriateness or any other aspect of them. The incorporation of any such link on the beauVoyage platform does not imply an endorsement by us of such services or any association with its operators. You further acknowledge and agree that beauVoyage shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods or services available on or through any third party website or resource.
beauVoyage online offerings may require an Internet connection from a third party provider in order to use some features. In such cases, your Internet connection is subject to the fees, restrictions, terms and limitations imposed by your provider. beauVoyage is not responsible for outages or disruptions of the Internet and telecommunications infrastructure which are beyond our control and can lead to interruptions in the availability of the beauVoyage platform.
beauVoyage may, temporarily and under consideration of the users’ legitimate interests (e.g. by providing prior notice), restrict the availability of the beauVoyage platform or certain areas or features thereof, if this is necessary in view of capacity limits, the security or integrity of our servers, or to carry out maintenance measures that ensure the proper or improved functioning of the beauVoyage services. We may improve, enhance and modify the platform and introduce new services from time to time.
3. Using the beauVoyage platform
We want our service to be as open and inclusive as possible. But we also want it to be safe, secure, and in accordance with the law. So, in order to be part of the beauVoyage community, we require you to make the below commitments to us.
You may view content made available on or through the beauVoyage platform without registering an account. However, the access and use of certain features of our service requires registration. You can register a beauVoyage account by using an e-mail address and creating a password, or through your account with certain third party social networking services, such as Facebook or Google. You are responsible for maintaining the confidentiality and security of your beauVoyage account credentials and should never disclose them to any third party. We recommend, but do not require, that you use your own name as your user name so your friends can recognise you more easily.
You shall not:
- sell, assign or otherwise transfer any aspect of your beauVoyage account (including your user name) to another party without our consent;
- create an account for someone else without such person’s express permission;
- use a user name or beauVoyage account that is subject to any rights of a person other than you without appropriate authorisation;
- use a user name that is the name of another person with the intent to impersonate that person;
- use a user name that is offensive, vulgar or obscene or otherwise unlawful.
beauVoyage reserves the right to refuse the registration of or cancel a user name (i.e., terminate your account) or to transfer the ownership of a user name if we believe it is appropriate or necessary; for example, if the user name infringes someone’s intellectual property or impersonates another person.
You will immediately notify beauVoyage in a written form if you know or have any reason to suspect that your login credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorised use of your beauVoyage account or other account-related security breach. You are solely responsible and liable for any and all activities conducted through your beauVoyage account, unless such activities are not authorised by you and you are not otherwise negligent (such as failing to report the unauthorised use or loss of your credentials).
In order to use our services, you must be an individual at least sixteen (16) years old and able to form legally binding contracts. If you are under the age required to manage your own beauVoyage account, you must have your parent or legal guardian’s permission to use our online offerings. Please have your parent or legal guardian read these terms with you. If you are a parent or legal guardian who has accepted these Terms, and you allow your child to use the beauVoyage services, then to the extent permitted by applicable law, you are responsible for your child’s activity on our platform.
If you create or use an account on behalf of a legal entity, you represent and warrant that you are authorised to act on behalf of such entity, in particular to register for the service as well as to enter into, and legally bind the entity to these Terms and Conditions, granting beauVoyage all permissions and licenses provided in this agreement. Such account is owned and controlled by the legal entity.
For you to register, we must not have previously disabled your account for violation of law or any of our policies.
beauVoyage may, in its sole discretion, refuse to offer the service to any person or entity for any reason and change its eligibility criteria at any time.
In the context of these Terms and Conditions, the term “content” includes, without limitation, any texts, comments, photographs, photo albums, videos, graphics, audio clips, location information, data, software, scripts, and interactive features generated, provided, or otherwise made accessible by beauVoyage on or through our service.
Content created, uploaded, submitted, posted, distributed, sent, received, stored or otherwise added and obtained by members on or through the beauVoyage platform, including content that is added to the beauVoyage service by members linking their accounts to third party websites and services is collectively referred to as “member content”.
Member content that you delete, will be removed from our database, and cannot be recovered. However, you understand that any removed member content may persist in back-up copies for a reasonable period (but following removal will not be shared with others) and may remain with users who have previously accessed or downloaded content from your blogging website.
Content on the beauVoyage platform provided by beauVoyage itself, including proprietary beauVoyage content and any content licensed or authorised for the use by or through beauVoyage from third parties is collectively referred to as “beauVoyage content”.
The beauVoyage platform, beauVoyage content, and member content is in its entirety or in part protected by intellectual property rights and associated rights, including copyrights, trademark rights, patent rights, publicity rights, design rights, trade name rights, database rights, and neighbouring rights, as well as rights to knowhow (collectively, “Intellectual Property Rights”). You shall maintain and not infringe all copyright notices, information, and restrictions incorporated in or accompanying the beauVoyage platform or any content accessed through the beauVoyage service. Some, but not all, actions that may constitute infringement of these Intellectual Property Rights are reproducing, performing, displaying, distributing, copying, reverse engineering, decompiling, disassembling, or preparing derivative works from content that belongs to beauVoyage or beauVoyage members. Do not remove, obscure, or alter any of our branding, logos, or legal notices. Do not infringe any Intellectual Property Rights that belong to third parties affected by your use of our service.
You will not use, copy, adapt (or otherwise reproduce), modify, prepare derivative works of, distribute, store, license, sell, rent, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit the beauVoyage platform or any of its content for commercial (whether or not for profit) use or in any way that violates any third party rights without prior written permission by beauVoyage, or by the Intellectual Property Right holder, as applicable, or as otherwise permitted by law; except to the extent that you are the legal owner of the particular member content or as expressly allowed in these Terms. No licenses or rights are granted to you by implication or otherwise under any Intellectual Property Right owned or controlled by beauVoyage, except for the licenses and rights expressly granted in these Terms.
All content made available on or through the beauVoyage platform is the sole responsibility and liability of the person who originated the content. Accordingly, you represent and warrant that: (i) you either are the sole and exclusive owner of all member content that you provide or share on or through beauVoyage’s online offerings or you have all rights, licenses, consents and releases that are necessary to grant to beauVoyage the rights in and to such member content as well as to meet your other obligations, as contemplated under these Terms and Conditions; and (ii) neither the member content itself nor your posting, uploading, publication, submission or transmittal of the content or the use of any such content (or any portion thereof, including derivative works) by us, our users, or others in contract with us, in compliance with these Terms, will infringe, misappropriate or violate any third party rights, including but not limited to patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation. Users indemnify beauVoyage against any and all third party claims, based upon any alleged infringement of such third party rights in relation to the content. beauVoyage cannot guarantee the authenticity of any content or data, which users may provide about themselves.
You retain the Intellectual Property Rights relating to the content you make available through the beauVoyage service. If you believe that any content on the beauVoyage platform infringes copyrights you own, please notify us.
You acknowledge that all content accessed by you using the beauVoyage service is at your own risk and you will be solely responsible and liable for any damage or loss to you or any other party resulting therefrom.
You are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to your use of the beauVoyage service. Concerning activities in connection with the beauVoyage platform, you will not (and shall not assist, enable or permit any third party to) either (a) take any action or (b) upload, download, post, publish, submit, transmit or otherwise distribute or facilitate distribution of any content on or through the beauVoyage platform, that:
- infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity or violates any law or contractual duty;
- is false, misleading (directly or by omission or failure to update information), deceptive, untruthful or inaccurate;
- is unlawful, abusive, harassing, defamatory, libellous, fraudulent, invasive of another’s privacy, tortious, obscene, vulgar, offensive, profane, pornographic, contains or depicts nudity, contains or depicts sexual activity;
- promotes bigotry, discrimination, racism, hatred, harassment or harm against any individual or group;
- is violent or threatening or promotes violence or actions that are threatening to any other person or animal
- promotes illegal or harmful activities or substances
- constitutes unauthorised or unsolicited advertising, junk or bulk electronic communication (“spamming”);
- involves commercial activities (whether or not for profit) and/or sales without beauVoyage’s prior written consent, such as contests, sweepstakes, barter, advertising, chain letters, or pyramid schemes;
- contains software viruses or any other technologies, such as computer codes, files, worms, logic bombs or programs that are designed or intended to disrupt, disable, damage, limit, or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorised access to any system, data, password or other information of beauVoyage or any third party or otherwise harm beauVoyage’s or third party’s interests or properties;
- impersonates another person or entity;
- includes anyone’s identification documents or sensitive financial information;
- is otherwise inappropriate as determined by beauVoyage in its sole discretion.
beauVoyage has a zero-tolerance policy against child pornography, and will terminate the account of any member who publishes or distributes child pornography We will report the case 1to the appropriate authorities.
You shall not (directly or indirectly)
- discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation, or otherwise engage in any violent, harmful, abusive or disruptive behaviour;
- violate or infringe anyone else’s rights or otherwise cause harm to anyone;
- modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, republish, repurpose, sell, trade, or in any way exploit our services or platform content (other than your member content), except as expressly authorised by beauVoyage
- use the beauVoyage platform or any of its content for any commercial or other purposes that are not expressly permitted by these Terms or in a manner that falsely implies beauVoyage endorsement, partnership or otherwise misleads others as to your affiliation with beauVoyage;
- use, harvest, scrape, copy, display, mirror or frame the beauVoyage platform or any of its content, or any individual element within the beauVoyage platform, beauVoyage’s name, any beauVoyage trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page in beauVoyage’s online offerings, without our express written consent;
- dilute, tarnish or otherwise harm the beauVoyage brand in any way, including through unauthorised use of the platform’s content, registering and/or using beauVoyage or derivative terms in domain names, trade names, trademarks or other source identifiers, or registering and/or using domain names, trade names, trademarks or other source identifiers that closely imitate or are confusingly similar to beauVoyage domains, trademarks, taglines, promotional campaigns or content from the beauVoyage platform;
- use any robot, spider, crawler, scraper, data mining tools, data gathering and extraction tools, or other manual or automated means or processes to access, collect data or other content from or otherwise interact with the beauVoyage platform for any purpose, except with the prior express permission of beauVoyage;
- decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code, underlying ideas, or algorithms of any part of the beauVoyage platform (including without limitation any application or widget) or any of the software used to provide the beauVoyage services, except to the limited extent applicable laws specifically prohibit such restriction;
- export or re-export any beauVoyage application or tool, except in compliance with the export control laws of any relevant jurisdictions and in accordance with posted rules and restrictions;
- take any action that damages or adversely affects, or could damage or adversely affect the performance or proper functioning of the services or any activities conducted on the beauVoyage platform;
- avoid, bypass, remove, deactivate, impair, descramble, or otherwise attempt to circumvent any technological measure implemented by beauVoyage or any of beauVoyage’s providers or any other third party to prevent or restrict access to the service (or other accounts, computer systems or networks connected to the service) or to protect the beauVoyage platform;
- take any action that imposes or may impose (as determined by beauVoyage in its sole discretion) an unreasonable or disproportionately large load on beauVoyage’s (or our third party providers’) infrastructure;
- run any form of auto-responder on the service or use the beauVoyage platform in connection with the distribution of unsolicited commercial messages (“spam”);
- copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder;
- recruit or otherwise solicit any member to join third party services, applications or websites, without beauVoyage’s prior written approval;
- otherwise take any action in violation of beauVoyage’s guidelines and policies.
Additionally, if you represent a business, you shall abide by any advertising, marketing, privacy, or other self-regulatory code(s) applicable to your industry.
beauVoyage does not guarantee that any content will be made available on the platform or through the service. beauVoyage has no obligation to monitor the platform, service, or content nor to actively seek facts or circumstances indicating illegal activity. However, beauVoyage reserves the right to access, read, preserve, disclose, edit, modify, delay, remove, suspend, or disable access to, any hosted content as beauVoyage reasonably believes is necessary to (i) comply with any applicable law, regulation, legal process, or the request, order, or requirement of a court, law enforcement, or other administrative agency or governmental body, (ii) enforce these Terms and Conditions, including investigations of potential violations hereof, (iii) operate, secure and improve the security of the beauVoyage platform (including without limitation for the detection and prevention of fraud and technical issues, risk assessment, investigation and user support purposes) (iv) protect the rights, property or safety of beauVoyage, its users and the public. beauVoyage also reserves these rights for reasons including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such content or if beauVoyage is concerned that you may have violated applicable law, these Terms, or for no reason at all.
beauVoyage deploys a combination of automated systems and manual checking of member content to detect and prevent fraudulent activity or violations of applicable laws, these Terms, or any other beauVoyage policies. This scanning and analysis may occur before, during, or after the post is published, and may result in your post being delayed or withheld.
Your rights under this agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, we may immediately revoke your access to the beauVoyage services. beauVoyage’s failure to insist upon or enforce your strict compliance with these Terms and Conditions will not constitute a waiver of any of its rights.
Furthermore, if we believe you are abusing the beauVoyage platform and/or our services in any way, we may, in our sole discretion, limit, suspend, or terminate your user account and access to our services, delay or remove hosted content, remove any special status associated with your account, and take technical and/or legal steps to prevent you from using our services.
Where beauVoyage removes or disables member content, we will notify the member and provide the reasons for such a measure, unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other members or third parties, or (iii) contravene applicable laws. You may appeal such a decision by contacting us by mail at

Members agree to cooperate with and assist beauVoyage in good faith, and to provide us with such information and take such actions as may be reasonably requested by beauVoyage with respect to any investigation undertaken by beauVoyage or a representative of beauVoyage regarding the use or abuse of our platform.
If you feel that any member you interact with, whether online or in person, is acting or has acted inappropriately, including but not limited to anyone who engages in offensive, violent or sexually inappropriate behaviour, or engages in any other disturbing conduct, you should immediately report such person to the appropriate authorities and then to beauVoyage by contacting us with your police station and report number (if available). You agree that any report you make will not obligate us to take any action (beyond that required by law, if any).
4. Conditions of sale
beauVoyage may charge fees to members for the use of the beauVoyage platform. More information on when service fees apply and how they are calculated can be found on our service fees page. Any applicable service fees (including any applicable taxes) will be displayed to a user prior to subscription. beauVoyage reserves the right to change the service fees at any time with effect for the next term, without advanced notice. You are responsible for paying any service fees (including any applicable taxes) that you owe to beauVoyage – either via credit card or via PayPal. Service fees are non-refundable.
In order to subscribe to the beauVoyage service, you must be at least eighteen (18) years of age or have the applicable age of majority in your jurisdiction. Upon subscription, you will be required to give us valid information of your credit card together with an accurate and current billing address or your PayPal information. Failure to do so shall constitute a breach of these Terms and Conditions, which may result in immediate termination of your beauVoyage account. You agree to immediately notify beauVoyage of any change in the information of your credit card or billing address used for payment hereunder. By providing beauVoyage with your credit card or PayPal information, you agree that no additional notice or consent is required before beauVoyage is authorised to invoice you for all fees and charges due and payable to beauVoyage. Your credit card issuer agreement governs your use of your designated credit card, and you must refer to that agreement and not beauVoyage’s Terms and Conditions to determine your rights and liabilities as a cardholder.
Any credit issued to you by beauVoyage has no cash value and is not exchangeable as cash. beauVoyage credit may be redeemed towards future service fee payments to beauVoyage and will be applied in the subscription process. beauVoyage credit is valid for three (3) years from the date of the generation of the credit. When your beauVoyage credit expires, it becomes invalid.
beauVoyage may offer you promotional coupon codes, which give you a discount on your service fees. Any coupon code issued to you by beauVoyage has no cash value and is not exchangeable as cash. beauVoyage coupon codes may be redeemed towards future service fee payments to beauVoyage. Only one coupon code can be used per subscription. Coupon codes are valid until the date mentioned on the coupon code, or otherwise until six (6) months after you have first received the code. Coupon codes cannot be applied to taxes or previous subscriptions to the beauVoyage service. We reserve the right to change or cancel the terms and/or value of coupon codes at any time without notice.
You must notify us in a written form within seven (7) days after receiving your credit card statement, if you dispute any of our charges on that statement or such dispute will be deemed waived. Such notification shall be sent to the following postal address:

5. Term, termination, suspension, and other measures
This agreement shall be effective for a one-calendar-year-term, at the end of which it will automatically and continuously renew for subsequent one-calendar-year-terms until such time when you or beauVoyage terminate the agreement in accordance with this provision.
If you wish to terminate this agreement and delete your account, you may do so by following the instructions on the platform. We may terminate unconfirmed accounts or accounts that have been inactive for more than three (3) years. beauVoyage may, with or without notice, stop providing access to all or any part of the beauVoyage services (i.e., terminate your account) and thus terminate this agreement at any time, effective immediately (i) if you have breached your obligations under these Terms, or any other beauVoyage policies, (ii) if you have violated applicable laws, regulations or third party rights, (iii) if we are required to do so to comply with a legal requirement or a court order, (iv) if beauVoyage believes in good faith that such action is reasonably necessary to protect the personal safety or property of beauVoyage, its members, or third parties (for example in the case of fraudulent behaviour of a member), or (v) for any reason at our sole discretion. The aforementioned termination may result in the forfeiture and destruction of all information associated with your membership. Any fees paid hereunder are non-refundable. If you believe your account has been terminated in error, you can appeal by mail at

In addition, beauVoyage may take any of the following measures (i) to comply with any applicable law, regulation, legal process, or the order, request or requirement of a court, law enforcement or other administrative agency or governmental body, (ii) if you have breached these Terms, or any other beauVoyage policies, applicable laws, regulations, or third party rights, (iii) if you have provided inaccurate, fraudulent, outdated or incomplete information during the beauVoyage subscription, (iv) if beauVoyage believes in good faith that such action is reasonably necessary to protect the personal safety or property of beauVoyage, its members, or third parties, or to prevent fraud or other illegal activity:
- refuse to surface, delete or delay any member content;
- limit your access to or use of the beauVoyage platform;
- temporarily or permanently revoke any special status associated with your beauVoyage account;
- temporarily or in case of severe or repeated offenses permanently suspend your beauVoyage account and stop providing access to the beauVoyage platform.
When this agreement has been terminated, you are not entitled to a restoration of your beauVoyage account or any of your member content. If your access to or use of the beauVoyage platform has been limited or your beauVoyage account has been suspended or this agreement has been terminated by us, you may not register a new beauVoyage account or access and use the beauVoyage platform through a beauVoyage account of another member.
All provisions of these Terms and Conditions which by their nature should survive termination shall survive any termination or expiration of this agreement and will continue to apply even if you stop using the beauVoyage online offerings or delete your beauVoyage account, including, without limitation, ownership provisions, warranty disclaimers, fees, content, indemnification, and limitations of liability.

Please provide only specific feedback on beauVoyage’s existing services or marketing strategies; do not include any ideas that beauVoyage’s policies will not permit us to accept or consider. Any feedback you provide to beauVoyage or any of its employees will be considered non-confidential and non-proprietary to you. By submitting Feedback to us, you grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation or attribution to you.
7. Warranty disclaimer
If you choose to use the beauVoyage service, you do so voluntarily and at your sole risk. The beauVoyage platform and its content are provided “AS IS” and “AS AVAILABLE”. Accordingly, to the extent permitted by applicable law, we exclude all express or implied warranties, terms and conditions of all kinds, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
You acknowledge that beauVoyage has no control over, and no duty to take any action regarding: which users gain access to the service; what content you access via the beauVoyage service; what effects the content may have on you; how you may interpret or use the content; or what actions you may take as a result of having been exposed to the content. Our service may contain, or direct you to websites containing information that some people may find offensive or inappropriate. beauVoyage makes no representations concerning any content contained in or accessed through the service, and beauVoyage will not be responsible or liable for the accuracy, suitability, quality, copyright compliance, legality or decency of material contained in or accessed through our service. In the event that you should encounter any incorrect information or links, we would appreciate it if you could inform us via e-mail. Please send any suggestions or criticisms to email@example.com.
You release us from all liability relating to your connections and relationships with other users.
You understand that we do not, in any way, screen users, nor do we inquire into the backgrounds of users or attempt to verify their backgrounds or statements. We make no representations or warranties as to the conduct of users or the veracity of any information users provide.
In no event shall neither beauVoyage, nor any other party involved in creating, producing, or delivering the beauVoyage platform or its content be liable, and you agree not to hold us responsible, for any damages and losses (including, but not limited to, loss of money, profits, goodwill, data or reputation, other intangible losses, or any direct, indirect, general, exemplary, special, compensatory, consequential, and/or incidental damages, including, without limitation, personal or bodily injury, emotional distress or computer damage, system failure, service interruption), directly or indirectly arising out of or relating to:
- these Terms and Conditions;
- the content you provide (directly or indirectly) using the service;
- your use of or your inability to use the beauVoyage services;
- the conduct of you or anyone else in connection with our services;
- any communications, interactions or meetings with other members or persons you may otherwise meet through the service;
- delays or disruptions in our service;
- viruses or other malicious software obtained by accessing or linking to our service;
- glitches, bugs, errors, or inaccuracies of any kind in our service;
- damage to your hardware device from the use of any beauVoyage service;
- the content, actions, or inactions of third parties;
- a suspension, termination, or other measure taken with respect to your account;
- your need to modify practices, content, or behaviour as a result of changes to these Terms or other beauVoyage policies.
As such, you agree to take reasonable precautions and exercise the utmost personal care in all interactions with any individual you come into contact with through the beauVoyage service statutory, particularly if you decide to meet such individuals in person. For example, you should not, under any circumstances, provide your financial information (e.g., credit card or bank account numbers) to other individuals.
You acknowledge and agree that the entire risk arising from your access to and use of the beauVoyage platform and its content, your publishing of postings or any interaction you have with other members, whether in person or online, remains with you. beauVoyage’s liability, whether based upon (attributable) default, unlawful act or any other ground, is excluded.
You shall release, defend, indemnify, and hold harmless beauVoyage, its affiliates and each of its and its affiliates’ employees, contractors, officers, directors, agents, suppliers and representatives from all losses, costs, actions, claims, damages, expenses (including reasonable legal costs and accounting fees) or liabilities, that arise from or in any way connected with (i) your use or misuse of, or access to the platform, service, content or (ii) violation of these Terms and Conditions or our other policies and standards, or infringement by you, or any third party using your account, of any laws or regulations, intellectual property right or other rights of any person or entity (save to the extent that a court of competent jurisdiction holds that such claim arose due to an act or omission of beauVoyage), (iii) your interaction with any other member. beauVoyage reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with us in asserting any available defenses.
10. Governing law
You and beauVoyage agree that any cause of action arising out of or related to the service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. These Terms and Conditions and any disputes or claims arising out of or in connection with it shall be governed by, and construed in accordance with, the laws of Germany.
11. General provisions
These Terms and Conditions and all other beauVoyage policies posted on our platform constitute the entire understanding and agreement between you and beauVoyage with respect to our service and the use of the services, platform, and its content. They supersede all prior or contemporaneous communications, proposals, or understandings (whether oral, written or electronic) of the parties regarding our service.
If any provision of these Terms and Conditions is deemed unenforceable, void or invalid, that provision shall be limited or eliminated to the minimum extent necessary and severed so that the validity and enforceability of the remaining provisions will not be affected.
The failure of either party to exercise in any respect any right or provision in these Terms will not constitute a waiver of any further rights or provisions hereunder. Waiver of compliance in any particular instance does not mean that we will waive compliance in the future. In order for any waiver of compliance with these Terms and Conditions to be binding, beauVoyage must provide you with written acknowledgement and agreement of such waiver through one of its authorised representatives. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise permitted under law.
beauVoyage shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond beauVoyage’s reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including “line-noise” interference).
These Terms and Conditions personal to you. You may not assign, transfer, sub-license or delegate this agreement as well as your rights and obligations hereunder without beauVoyage’s prior written consent. beauVoyage may without restriction assign, transfer or delegate this agreement and any of its rights and obligations hereunder, at its sole discretion, without consent. Your right to terminate this agreement at any time remains unaffected.
No agency, partnership, joint venture, franchise or employment relationship is intended or created between you and beauVoyage as a result of this agreement or your use of the beauVoyage platform and neither party has any authority of any kind to bind the other in any respect.
Unless otherwise specified in these Terms and Conditions any notices or other communications permitted or required under this agreement will be provided in writing and will be deemed to have been duly given when received, if personally delivered or sent by certified or registered mail, return receipt requested; when receipt is electronically confirmed, if transmitted by facsimile or e-mail; or the day after it is sent, if sent for next day delivery by recognised overnight delivery service.
12. Amendments and changes to the beauVoyage services
beauVoyage reserves the right, at its sole discretion, to amend (including modifying, adding, removing terms) or replace any of these Terms and Conditions. Changes take effect when we post the revised terms on the beauVoyage platform. It is your responsibility to check these Terms periodically for modifications. If you disagree with the revised Terms and Conditions, you may terminate this agreement with immediate effect. Your continued use of the service after the effective date of any changes to this agreement will constitute your acceptance of those revised Terms and Conditions, which you will then be bound by.
We may change, suspend, or discontinue the services, or any part of them (including, without limitation, the availability of any feature, database, or content) at any time without notice. beauVoyage may also impose limits on certain features and services or restrict your access to parts or the entire service without notice or liability.
